A federal appeals court on September 10 stopped the Trump administration from implementing new United States Postal Service (USPS) rules that change mail-in voting requirements ahead of the November 3 midterm elections.
Legal Challenges and Concerns About Voting
This decision follows a similar request currently under review by the Supreme Court. The three-judge panel of the appeals court rejected a request to halt an order issued on September 4 by Judge Indira Talwani of the Massachusetts District Court. This temporary ruling, approved on August 27, halts key provisions of the final USPS law.
The ruling not only applies to the November 3 elections but also to any elections held before that date. Specifically, it blocks the mandatory requirements of the USPS law published on August 26. Under this law, federal agencies will have greater responsibility in determining who receives mail-in ballots and how they are processed by USPS.
Judge's Opinion and Legal Implications
Judge Talwani stated that this law could lead to the loss of voters' rights and may likely be illegal and unconstitutional, as it allows states to conduct federal elections within their borders. She also noted that USPS has not provided any evidence of fraudulent mail-in voting that would justify this new law.
The Trump administration had previously claimed that this executive order would help maintain the integrity of federal elections. The Department of Justice also argued that USPS, under its general powers to regulate mail, implements design and data requirements for mail, rather than determining who is eligible to vote.
However, Judge Talwani emphasized that this law conflicts with Congress's powers and that its implementation under current circumstances for the midterm elections is "virtually impossible." There are serious concerns about minor issues arising in the new system and their impact on voters' rights.
Advocacy groups and a coalition of Democratic-led states have filed lawsuits to prevent the implementation of this law, while Republican states have acted to support the federal government.
